2. Legal Bases for Processing Your Personal Data
Processing personal data requires a legal basis, which we will outline below.
For processing personal data where we obtain the consent of the data subject, Article 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis.
When processing personal data required for the performance of a contract to which the data subject is a party, Article 6(1)(b) GDPR serves as the legal basis. This also includes processing activities necessary for carrying out pre-contractual measures.
If processing personal data is necessary to fulfill a legal obligation to which our company is subject, Article 6(1)(c) GDPR serves as the legal basis.
If processing is necessary for the protection of legitimate interests pursued by our company or a third party, and the interests, rights, and freedoms of the data subject do not override the legitimate interest, Article 6(1)(f) GDPR serves as the legal basis. Our legitimate interest lies in conducting our business activities, as well as analyzing, optimizing, and maintaining the security of our online offerings.
3. Rights of the Data Subject
You have the right to access the personal data we hold about you. In particular, you can request information about the purposes of processing, the categories of personal data, the categories of recipients to whom your data has been disclosed or will be disclosed, the planned duration of storage, the source of your data if not collected by us, and the existence of automated decision-making, including profiling, and if applicable, meaningful information about its details.
Under applicable laws, you also have the right to rectification of inaccurate data, restriction of processing, data portability, and deletion of your personal data. To do so, please send us an email with the subject “Data Protection.”
You also have the right to file a complaint with a data protection supervisory authority if you believe that the processing of your personal data violates legal provisions.
For reasons related to your particular situation, you may object to the processing of your personal data based on Article 6(1)(e) or (f) of the GDPR, including profiling based on these provisions (Article 21 GDPR). If the legal conditions are met, we will no longer process your personal data.
In the case of direct marketing, you have the right to object at any time to the processing of your personal data for the purposes of such marketing, including profiling related to direct marketing.
If you have given consent, you have the right to withdraw that consent at any time. This does not affect the lawfulness of the processing based on consent before the withdrawal.
We do not currently carry out automated decision-making, including profiling.
If you exercise any of the rights mentioned above, we will process the personal data collected in this context to respond to your request. The processing of your personal data is carried out to fulfill a legal obligation.
In the event of an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for processing that override your interests, rights, and freedoms, or if your personal data is necessary for the establishment, exercise, or defense of legal claims.
4. Storage Duration of Personal Data
Unless we have specified concrete retention periods, we retain personal data for the duration of the respective legal retention period or as long as the purpose of the collection exists. After the retention period expires, the data will be routinely deleted unless required for contract initiation or fulfillment. If user data is not deleted because it is required for other legally permissible purposes, its processing will be restricted as much as possible. The data will be blocked and not processed for other purposes, for example, data that must be retained for commercial or tax purposes.
II. Contractual Processing
When you enter into a contractual relationship with us, we typically collect the following data: salutation, first and last name, email address, address, phone/mobile number, and information necessary for contract execution.
We need this data to identify you as a contractual partner, execute the contract, contact you, and for billing purposes. The data processing occurs at your/our request or order and is necessary for the mutual fulfillment of obligations under the contract.
For legitimate interests, we may also process data, such as for the assertion or defense of claims arising from the contractual relationship. The collected personal data is stored until the expiration of the contractual relationship and then deleted, unless we are required by legal obligations to retain it for a longer period due to tax and commercial retention and documentation obligations (under the HGB, StGB, or AO).

IV. Data Processing on the Website and Our App
1. Log Files, Hosting
Server statistics automatically store data that the browser transmits to us as part of our legitimate interest in analysis and security (so-called “logfiles”).
These are the following data for the website:
- Language and version of browser software
- Operating system used and its interface
- Referrer URL (the previously visited page)
- Hostname of the accessing computer (IP address)
- Date and time of the server request
- Time zone difference to Greenwich Mean Time (GMT)
- Content of the request (specific page)
- Data transmitted
- Access status/HTTP status code
For the app, the following data are collected:
- Date and time of app retrieval
- Data transmitted and access status (file transmitted, file not found, etc.)
- IP address
- Host
- Operating system used
- Device type
These data cannot usually be attributed to specific individuals. We do not merge these data with other data sources. The data is deleted after statistical evaluation within 7 days. Data that must be kept for evidentiary purposes are exempt from deletion until the incident is clarified.
We use hosting services that provide infrastructure and platform services, computing capacity, storage space, database services, security services, and technical maintenance to maintain this online offering.
In this regard, we or our hosting provider process master data, contact data, content data, contract data, usage data, metadata, and communication data of customers, prospects, and visitors to this online offering based on our legitimate interests in the efficient and secure provision of this online offering.
2. App Function Usage – Additional Consent Purposes
Personal data you provide for contractual purposes, such as for inquiries and use of app functions, including your name, address, or email address, are used internally only to respond to inquiries, process orders, or grant access to certain contractual information.
To use the location, video (microphone), and photo features of the app, you may grant access to these functions. The app asks for your consent for this (“May the app access location/camera/microphone/photos?”). We can use your location during a visit to us or when you are nearby to send you current notifications. If you have agreed, you can withdraw this consent at any time via your device’s general settings.
Push notifications, including marketing messages, may also be sent. You grant consent for receiving push notifications when you answer “yes” to the app’s inquiry (“May the app send you notifications?”). The consent can be managed or withdrawn in the device’s general settings.
Other marketing messages (newsletters) or phone calls occur only if you have explicitly consented.
3. Contacting Us
When you contact us, for example via email, we store your information to respond to your inquiries. We do not generally share this information with third parties unless applicable data protection regulations justify a transfer or we are legally required to do so. You can withdraw your consent at any time with effect for the future. In the event of withdrawal, your data will be immediately deleted unless there are legal exceptions for further processing. Otherwise, your data will be deleted once we have processed your request or the purpose of storing the data no longer applies, and there are no legal exceptions to the contrary.
4. Cookies
Cookies are small text files stored on your computer, through which the entity that sets the cookie receives certain information. They are used to make the online service more user-friendly and effective and/or to facilitate navigation on our website. We only use cookies that are not strictly necessary with your consent. You can withdraw this consent at any time for future use.
The consent is voluntary, and you can also use our website without accepting cookies. 5. Outlets Insider Club
We offer you membership in our Outlets Insider Club, for which we collect and use the data you provide and the data described below. When participating in the bonus program, a personal QR code is generated for the respective customer at Designer Outlets Wolfsburg, which can be used to obtain various discounts at participating brands in the Designer Outlet Center Wolfsburg or participate in various actions and events. Further specific information about the participating brands, prerequisites, and descriptions of specific actions and events are available in our app.
By participating in the bonus program, you consent to us storing your use of discounts and actions and using this data for analysis and marketing purposes. For brand actions, the sales generated by your purchases with the respective brand are stored and used. Customer identification for this purchase or action is done based on age, gender, purchase time, residence, and participating brand.
You can deactivate your participation in the bonus program at any time for a specific period, so all uses of your data are blocked and can only be resumed upon reactivation by you. You can also delete your membership at any time. Deleting the customer account is permanent. An exception applies to the storage of customer data if there are serious violations by the customer of legal regulations, third-party rights, or our terms and conditions. This is to prevent the customer from re-registering. Another exception applies if there is a legal obligation to store the data.
We offer registration and login options for our Outlets Insider Club, partly through our app. The personal data entered during registration is transmitted to the responsible party for processing. The data is stored exclusively for internal use by us. During login, the user’s IP address, as well as the date and time of the login, are stored to prevent misuse of the services. Data is not shared with third parties unless there is a legal obligation to do so.
The registration of the data is necessary to provide content or services. Registered users can at any time request that their stored data be deleted or modified. The affected person has the right to obtain information at any time about the personal data stored about them.
When registering for our “Designer Outlets Pass,” we collect your name, postal code, and email address. This data and the QR code assigned to you within the bonus program are used to credit the respective discounts to your purchases (legal basis: Art. 6 (1) S.1 lit. b GDPR). If you withdraw your consent for this, the assigned QR code will lose its validity.

V. Newsletter and Information for Interested Parties
1. Newsletter
If you wish to receive the newsletter offered on our website and possibly in our app, we need a valid email address from you, which allows us to verify that you are the owner of the provided email address or that the owner agrees to receive the newsletter.
We collect additional data requested in the registration form to offer benefits within a customer relationship and to use your data to improve and tailor our offerings to individual customer preferences. The specific purposes are also outlined in the consent text during registration.
Once you provide your email address, we send a confirmation email to that address asking you to confirm that you wish to receive the newsletter. If you do not confirm within 24 hours, your data will automatically be deleted in relation to the newsletter dispatch. If you confirm that you want to receive the newsletter, we store your email address until you unsubscribe from the newsletter. We only send newsletters with your consent or a legal permission.

We would like to point out that, based on your consent, we evaluate your user behavior when sending the newsletter. To do this, the sent emails include web beacons, also known as tracking pixels. These are one-pixel image files that link to our website, allowing us to analyze your user behavior. This is done by collecting the email address and web beacons, which are associated with your email address and linked to a unique ID. Links in the newsletter also contain this ID. With this data, we create a user profile to provide you with the newsletter tailored to your interests. If users have only signed up for the newsletter and unsubscribed, their personal data will be deleted.
2. Information to Existing Customers
If you have entered into a contract with us for our services, we will offer you further information about similar services via the email address provided at the time of contract conclusion (§ 7 III UWG). You may object to this transmission at any time.
These communications are based on our legitimate advertising interest.
VI. Disclosure of Data: General and Contractual Purpose
We share data with third parties when necessary for the fulfillment of the contract and/or when we are legally obligated and/or authorized to do so. The data is typically shared with service providers such as hosting, operation, maintenance, and support of IT systems, communication systems, and waste disposal services. Additionally, your data may be transmitted to postal or delivery services, your bank, tax advisors/auditors, and lawyers.
1. Payment Service PayPal
If you choose to pay via the online payment service provider PayPal during your order process, your contact data will be transmitted to PayPal upon completing the order. PayPal is offered by PayPal (Europe) S.à.r.l. & Cie. S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. PayPal acts as an online payment service provider and trustee, offering buyer protection services.
The personal data transmitted to PayPal includes information necessary for order processing, as well as data related to the order, such as the number of items, item number, and invoice amount.
This transmission is necessary to process your order with your chosen payment method, especially to confirm your identity, administer your payment, and manage the customer relationship.
Depending on the payment method selected via PayPal, such as invoice or direct debit, the personal data transmitted to PayPal will be forwarded to credit agencies. This transmission serves to check the identity and creditworthiness regarding your order. 2. Payment Service Unzer
Since we do not process your payment directly, the collection, processing, and storage of data for electronic payment transactions is carried out exclusively by our partner, Unzer Luxembourg S.A. société anonyme, Parc d´Activité Syrdall 2, 18 – 20 rue Gabriel Lippmann, L- 5365 Munsbach (hereafter Unzer).
Unzer will receive the following data directly from you in connection with your order as part of the electronic payment process: title, gender, first name, last name, company, address, postal code, city, country, customer number, email, and payment type.
For credit card payments, the following additional information will be transferred directly to Unzer: credit card number, credit card holder, credit card validity (month and year), and credit card CVC.
For online bank transfer payments, additional information such as the account holder, bank name, account number or IBAN, and bank code or BIC may be transferred to Unzer, depending on the system.
For prepayment, the following information will be transferred to Unzer to simplify the allocation of your payment: IBAN, BIC, and account holder.

c. Google AdWords and Conversion Tracking
This website uses “Google AdWords” and, as part of Google AdWords, conversion tracking. If you click on an ad displayed by Google, “cookies” (text files) are set on your computer. These cookies expire after 30 days and are not used for personal identification. This allows Google and us to recognize that the user clicked on the ad and was redirected to this page. 2. Meta (Facebook)
We use services of the social network facebook.com, operated by Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland (“Facebook” or “Meta”) for analysis, optimization, and the efficient operation of our online services based on your consent. The US company Meta Platforms Inc. is certified under the Data Privacy Framework, so measures have been taken to ensure compliance with European data protection law.
a. Facebook Social Plugins

Our website uses Facebook’s advertising tools Custom Audiences and Website Custom Audiences. In this process, a non-reversible, non-personally identifiable hash value is generated from your usage data, which is transmitted to Facebook for analysis and marketing purposes on its social platform and stored in the USA.
The Facebook pixel is embedded on our website when you visit, and it may store a cookie on your device. If you later log into Facebook or visit Facebook while logged in, your visit to our online service is recorded in your profile. VIII. Data Storage Outside the EU/EEA
As mentioned in the descriptions of individual tools, we use tools from US third-party providers. If necessary for the stated purposes, it may occur that your IP address is processed outside the European Economic Area, where an EU-compliant level of data protection is not always guaranteed or confirmed (e.g., through appropriate safeguards as per Article 46 GDPR or an adequacy decision by the European Commission). It cannot therefore be excluded that security authorities in a third country may gain access to your IP address without legal remedies available.
The transmission of the IP address to these third-party providers is carried out in accordance with Article 49(1)(a) GDPR based on your express consent provided in the consent banner. This consent is voluntary, and you may revoke it at any time with effect for the future. There will be no disadvantages to you.
Some US third-party providers claim that, due to the conclusion of standard contractual clauses and additional measures in line with the Schrems II ruling, an EU-compliant level of protection is ensured. However, since the adequacy of such measures is disputed, we have decided to transmit your IP address only with your consent.
